I'm starting my own Podcast. As my intro music, I want to use part of a song from Ernesto Cortazar's 'Leaves in the Wind'

While I would like to contact the artist, I have not been able to locate him. Would I be in violation of a copyright to play a portion of his music as a lead=in for my Podcast?
